As the case I/P Engine v. Google (GOOG) is finished in the District Court with regards to past damages, it is time to look at what is at stake in the Appellate Court. Just for a brief review, Vringo (VRNG) was awarded $30.5 million for past damages on November 6, 2012, when the jury came back with a verdict in its favor. The $30.5 million accounted for past damages, but the Judge has recently ruled that VRNG is entitled to supplemental damages including a royalty base of 20.9% of Google's relevant revenue and interest. You can find out more about future damages and the royalty rate in my previous article here. This article is to focus on the issues VRNG is appealing in the Appellate Court [pdf].

1. Laches

The main issue Vringo is appealing is the District Court's laches ruling. On October 31, 2012, Judge Jackson ruled that damages would be limited to starting on September 15, 2011, which was the day it filed the complaint because of the doctrine of laches. VRNG was originally seeking damages going back to September 15, 2005. In a patent infringement case, you can seek damages within the last six (6) years unless laches applies. The ruling significantly hurt VRNG's hopes for the hundreds of millions of dollars that shareholders were hoping for.

The Company's Wireless DataCom segment is comprised of a Wireless Networks business and an MRM business. CalAmp's Wireless Networks business provides products, systems and services to industrial, utility, energy and transportation enterprises and state and local governmental entities for deployment where the ability to communicate with mobile personnel or to command and control remote assets is crucial. Utilities! , oil and gas, mining, railroad and security companies rely on CalAmp products for wireless data communications to and from outlying locations, permitting real-time monitoring, activation and control of remote equipment. The Company's DBS reception products are installed at subscriber premises to receive television programming signals transmitted from orbiting satellites. These DBS reception products consist principally of outdoor electronics that receive, process, amplify and switch satellite television signals for distribution over coaxial cable to multiple set-top boxes inside the home that can acquire, recognize and process the signal to create a picture.

    Opposition to the latest wireless rumored wireless merger might have come as a surprise to Sprint’s CEO/pitchman Daniel Hesse and Masayoshi Son, the head of Japan’s SoftBank (SFTBF), which acquired a controlling interest in Sprint for $1.9 billion last year. For one thing, it’s hard to imagine the new company posing much of a competitive threat. A combined Sprint/T-Mobile would have 53 million users — significantly greater than their individual parts, but still less than half the 110 million served by AT&T and the 120 million subscribers under the Verizon flag.
